Terms of use

BookSway is operated by NextPanel Studios LLC d/b/a BookSway, address 1805 Crystal Drive, 908S, Arlington, VA 22202. It provides author and creator accounts, a book library, creator campaigns, and campaign joining.

You must be at least 18 years old and able to form a contract to create a BookSway account. Provide accurate account information. Each account has one role: author or creator. You may sign in with email and password or Google. You are responsible for your sign-in credentials.

Authors are responsible for the books and campaign offers they publish on BookSway, including that they have the right to promote the book and to offer the stated creator reward. Authors must not use BookSway to misrepresent Amazon programs or Attribution eligibility.

Creators are responsible for how they promote a book off BookSway. Joining a campaign records the reward shown at that time. It does not guarantee income, audience, or Amazon-attributed results.

Creators independently choose which campaigns to join. Joining is optional. Creators are not BookSway employees, and joining a campaign does not create employment, agency, partnership, joint venture, or franchise with BookSway. BookSway does not direct how Creators promote a book off the platform, beyond these terms and product rules such as anti-abuse limits and campaign membership rules. Authors, not BookSway, incur the Creator reward obligation. BookSway provides tracking, reward calculation, and payment infrastructure.

A campaign belongs to one book. Authors may change the current offer for future joins according to product rules. Historical join rewards are not rewritten. BookSway may limit abuse, including duplicate or automated joining. Campaign membership follows product rules, which currently do not include self-serve leave.

You keep ownership of the books, covers, names, synopses, profile text, and other materials you upload. You grant NextPanel Studios LLC d/b/a BookSway a limited, worldwide, non-exclusive license to host, reproduce, resize, optimize, cache, display, and distribute that material as needed to operate and promote BookSway, including public campaign pages, the homepage, sitemaps, and profile or spotlight surfaces. This is not a transfer of ownership.

To report copyright infringement, write to NextPanel Studios LLC d/b/a BookSway, 1805 Crystal Drive, 908S, Arlington, VA 22202, or support@booksway.app. Include your contact information, the work you claim is infringed, the BookSway URL of the material, a good-faith statement that use is not authorized, a statement under penalty of perjury that your notice is accurate, and your signature. BookSway may remove or restrict the material after reviewing a complete notice.

Authors can securely connect their Amazon Ads account. For eligible connected profiles, BookSway sets up creator Attribution destinations automatically. Creators share one BookSway link and never receive Amazon credentials or raw Attribution URLs.

Amazon services are provided by Amazon, not BookSway. BookSway does not guarantee Amazon API access, Attribution eligibility, or reporting accuracy. Amazon, Kindle, KDP, Amazon Ads, and Amazon Attribution are trademarks of Amazon.com, Inc. or its affiliates. BookSway is an independent platform that integrates with Amazon Ads and Amazon Attribution. Amazon does not sponsor or endorse BookSway.

Authors pay Creators for recorded Creator rewards through Stripe. BookSway is not the payer and is not the debtor of those obligations. When an Author pays, Stripe Checkout creates a direct charge on that Creator's Stripe connected account. The Creator receives 100% of the Creator principal. BookSway collects a 10% success fee on successfully paid Creator principal as a platform/application fee. The Author also pays the estimated card-processing amount quoted at checkout. Processor charges are separate from Creator principal. There is no BookSway subscription and no Creator BookSway fee. The success fee is not a share of Amazon sales or KDP royalties. BookSway calculates Creator rewards from qualifying Amazon-attributed activity using the campaign frozen reward terms. Settled is not paid. BookSway does not say money is in a Creator bank account until Stripe marks a payout paid. Readers buy books on Amazon, not on BookSway.

Refunds, disputes, and chargebacks are handled through Stripe. An open dispute does not by itself reverse a recorded obligation or mean money has reached a Creator's bank. BookSway is the Stripe losses collector for connected-account negative balances on this payment path, which is separate from being the debtor of the Author's reward obligation. Processor-float true-ups can refund an Author without reducing Creator principal. Stripe-confirmed refunds that reduce Creator net can reverse Creator impact. Settled is not paid.

There is no standalone ecommerce refund policy. Payment outcomes follow Stripe and these terms, including the 10% success fee and quoted processor estimate.

Do not attempt to access another account, extract Amazon credentials, scrape private dashboards, or use BookSway for fraud, spam, or anything unlawful.

Authors and Creators retain rights in their own materials, subject to the license above. BookSway retains rights in the BookSway software and brand. You may not use Amazon trademarks except as needed to describe compatibility, and not in a way that implies Amazon endorsement.

BookSway is provided as available. Features may change. There is no uptime commitment in these terms.

To the extent permitted by law, BookSway is provided without warranties of uninterrupted service, fitness for a particular marketing result, or Amazon program eligibility. BookSway is not liable for lost profits, lost data, or indirect, incidental, special, or consequential damages. BookSway's total liability arising out of these terms or the service is limited to the greater of one hundred U.S. dollars (US$100) or the BookSway success fees you actually paid in the twelve months before the claim. This does not limit liability that cannot be limited under applicable law, including liability for fraud.

You will defend and indemnify NextPanel Studios LLC d/b/a BookSway against claims arising from your content, your off-platform promotion, your breach of these terms, or your unlawful use of BookSway, except to the extent caused by BookSway's own willful misconduct.

BookSway may suspend accounts that violate these terms or present a security risk. You may stop using BookSway at any time. There is no self-serve account wipe. To request deletion, email privacy@booksway.app. BookSway will review the request and remove account access it no longer needs to operate the product. Payment, security, and Amazon-connection records needed for legal, fraud, or accounting purposes may be retained.

These terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law rules. Exclusive venue is the state courts located in Arlington County, Virginia, and the United States District Court for the Eastern District of Virginia.
